[ARCHIVED] Commercial medical marijuana question heading to voters

Castle Rock voters are poised to decide at the Town’s April 5 election whether the Town’s ban on commercial medical marijuana operations should remain in place.

The vote is being triggered by a referendum on the ban, which the owner of the Town’s only commercial medical marijuana business initiated in October.

The owner submitted sufficient valid signatures from registered Castle Rock voters to refer the ban to Town Council for reconsideration.

Town Council was required by state law to either overturn the ban or to refer the question of whether the ban should remain in place to Castle Rock voters. Council voted 4-3 Tuesday in favor of the latter option.

An ordinance now is being prepared to place the question of whether the ban should remain in place on the ballot for the April 5 municipal election.

The ban is not in effect, pending the vote. Therefore, the current medical marijuana business may continue operations.

New commercial medical marijuana businesses may not open, however, as the Town has a moratorium on such businesses in place through June 30, 2011. After that, time medical marijuana businesses would need licenses from both the Town and the state to operate here.
