[ARCHIVED] Medical marijuana moratorium now in place through 2010

The state’s new medical marijuana laws offer Town Council three options for governing medical marijuana use in Castle Rock:

· Prohibit medical marijuana cultivation and sale in Town by ordinance

· Refer the question of prohibition to Castle Rock voters

· Regulate and zone the commercial activity

Council will need to decide which course to pursue – and has time to do so now that the Town’s moratorium on commercial medical marijuana permits, licenses and other approvals has been extended through 2010.

The moratorium had been set to expire July 4, but Council Tuesday voted 5-0 to extend it through Dec. 31.

“We need this motion in place to decide whether we feel it’s our role to make a decision on this or whether we see this as a voter issue,” Councilman Clark Hammelman said in voting for the extension.

The moratorium prohibits Town staff from “conducting pre-application conferences, accepting, processing and/or otherwise approving or acting upon any … Town approval, license or permit currently required for or applicable to medical marijuana commerce under current Code provisions and Town regulations.”

The suspension includes, but is not limited to, application for medical marijuana centers, optional premises cultivation and/or marijuana-infused product manufacturers licenses as these terms are defined and regulated under the Colorado Medical Marijuana Code.

All municipalities in Douglas County have similar suspensions in effect.

Town Council next will discuss the issue at its June 22 meeting, which begins at 6 p.m. at Town Hall, 100 N. Wilcox St. No decisions will be made, but public input is welcome.
