Notice is hereby given that 455 Alexander, LLC and Tierra Investors, LLC, have submitted a Petition for Annexation for property legally described as in the North Half of Section 26 of Township 7 South, Range 67 West of the 6th Principal Meridian, Douglas County Colorado. Located east of the Silver Heights subdivision, north of Alexander Place, and west of the Diamond Ridge Estates subdivision. 

All interested parties are invited to participate in the Town Council public hearing on Dec. 7, 2021 at 6 p.m. This is a hybrid meeting offering in-person and virtual attendance options. Public comments are encouraged.

Annexation is a three-step process. During the first two steps, Substantial Compliance and Eligibility, Town Council determines whether an annexation request meets the statutory requirements for annexation established in the Colorado Revised Statutes (C.R.S.), specifically the Municipal Annexation Act of 1965 (Act). The third step is when Town Council determines whether an annexation request complies with the Town’s guiding documents and the Municipal Code, and if the property should be annexed to the Town.  

On Oct. 19, 2021, Town Council voted 7-0 to approve Resolution No. 2021-095 finding that the Petition for annexation was in substantial compliance with the applicable sections of the Colorado Constitution and the Colorado Revised Statutes, and the date of the Eligibility Hearing was set for Tuesday, Dec. 7, 2021 at 6:00 p.m. at the Castle Rock Town Hall, 100 N. Wilcox Street, Castle Rock, Colorado.   

The purpose of the Eligibility Hearing is to enable Town Council to determine whether:

  1. The Property is eligible for annexation to the Town in accordance with the requirements of Article II, Section 30 of the Colorado Constitution and §§31-12-104 and 31-12-105, C.R.S.;
  2. Whether an election of the landowners and registered electors in the area to be annexed is required under Article II, Section 30(1)(a) of the Colorado Constitution and §31-12-107(2), C.R.S.; and 
  3. Whether additional terms and conditions are to be imposed upon the proposed annexation.

Project Information: 

The subject property consists of approximately 73.76 acres. The property is zoned A-1 – Agricultural One in unincorporated Douglas County. The proposed zoning for the property is Planned Development to allow for 53 single family homes and 24 live/work units.

Process Information:

The first two steps in the annexation process are procedural and subject to the requirements established in the Colorado Constitution and C.R.S. The first two steps, Substantial Compliance and Eligibility determine whether the property can be annexed to the Town. The third step, Annexation and Zoning determines whether a property should be annexed to the Town.

At the Substantial Compliance Hearing held on Oct. 19, 2021, Town Council approved a resolution finding that the Petition for annexation was in the prescribed form and contained the necessary statutory criteria. This allowed the annexation request to move to the second step in the annexation process.

At the upcoming Eligibility Hearing, Town Council will determine whether the statements made in the Petition (referred to as “allegations” in the statute) are supportable and that the property is eligible to be annexed under the Act.

Once an annexation petition has been found to be both substantially compliant and eligible for annexation, then the Annexation Petition and Plat, and the request for zoning may proceed to the Annexation and Zoning public hearings before the Planning Commission and Town Council. The dates of the Annexation and Zoning public hearings will be set and publicly noticed once the staff review of the proposal is complete and all comments have been addressed and resolved.
